    1. Introduction

    Welcome to VayaTribe! These Terms of Service (“Terms”) govern your access to and use of the VayaTribe website, services, and applications (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms.

    2. The VayaTribe Platform

    VayaTribe is a technology platform that connects tourists (“Tourists”) with local guides (“Local Guides”) who offer unique travel experiences and content in India.

    2.1. Our Role:

    • VayaTribe acts as a neutral facilitator to help Tourists and Local Guides connect.
    • We provide services such as user verification, content hosting, and standard video editing to assist Local Guides in creating their listings.
    • Important Disclaimer: VayaTribe is not a party to any agreement, contract, or transaction between Tourists and Local Guides. We do not act as an agent for any user. We are not a tour operator, travel agency, or insurer. We do not control the conduct of our users and disclaim all liability in this regard to the maximum extent permitted by law.

    3. User Accounts

    3.1. Eligibility:

    • You must be at least 18 years old to create an account on VayaTribe.

    3.2. Account Types:

    • Tourist: Users can browse the platform without an account, but must register to raise an inquiry.
    • Local Guide: To become a Local Guide, you must complete the full registration process, including profile creation and Know Your Customer (KYC) verification.

    3.3. Account Responsibility:

    • You are responsible for all activity that occurs under your account and for keeping your password confidential and secure.

    4. Terms for Local Guides

    4.1. Onboarding and KYC:

    • You agree to provide accurate, current, and complete information during the registration and KYC process. VayaTribe's Verification Team will review your identity and address documents. We reserve the right to approve or reject any application at our sole discretion.

    4.2. Listings:

    • You are solely responsible for the content of your listings, including titles, descriptions, and packages offered. All information provided must be accurate and not misleading.

    4.3. Content Submission:

    • You may upload raw video, audio, or image files ("Raw Content") to the Platform.

    4.3.1.

    • VayaTribe, at its discretion, may offer a complimentary standard video editing service to prepare your Raw Content for your listing. This is a non-monetary service provided to enhance the Platform's quality. VayaTribe is not obligated to provide high-end, cinematic, or specialized editing. The final decision on editing style rests with VayaTribe's editing team.

    4.3.2.

    • Alternatively, you may upload your own pre-edited video, which will be subject to VayaTribe's content approval process.

    4.4. Content Ownership:

    4.4.1.

    • You retain ownership of the Raw Content you upload.

    4.4.2.

    • Upon completion of the editing process by VayaTribe, the final edited video file ("Final Content") becomes the exclusive property of VayaTribe.

    4.4.3.

    • VayaTribe grants you, the Local Guide, a limited, non-exclusive, revocable license to use the Final Content solely within your listing on the VayaTribe Platform. You may not use the Final Content for any other commercial or personal purpose (e.g., on other social media sites, websites, or for personal promotion) without express written consent from VayaTribe.

    4.5. Interactions with Tourists:

    • Once a Tourist raises an enquiry, their contact information may be shared with you, and your contact information may be shared with them. You agree to communicate professionally and respectfully. You are solely responsible for the services you provide to the Tourist.

    5. Terms for Tourists

    5.1. Enquiries:

    • When you raise an enquiry on a listing, you are expressing interest in the Local Guide's services. This action will facilitate the sharing of contact details between you and the Local Guide.

    5.2. Due Diligence:

    • While VayaTribe conducts a basic KYC verification of Local Guides for safety purposes, we do not endorse any specific Local Guide or guarantee the quality, safety, or legality of their services. We encourage you to communicate directly with the Guide and exercise your own judgment before making any arrangements or payments.

    5.3. Agreements:

    • Any agreement, booking, or transaction you make with a Local Guide is solely between you and the Guide. VayaTribe is not involved in and holds no responsibility for this interaction.

    6. Platform Integrity

    • You agree not to:
    • Use the Platform for any illegal purpose.
    • Submit false or misleading information.
    • Harass, threaten, or otherwise violate the rights of other users.
    • Circumvent any security measures of the Platform.

    7. Limitation of Liability

    • The Platform is provided "as is" without any warranties. VayaTribe shall not be liable for any damages (direct, indirect, incidental, or consequential) arising from your use of the Platform or from any interaction, agreement, or transaction between Tourists and Local Guides.

    8. Termination

    • VayaTribe reserves the right to suspend or terminate your account and access to the Platform at any time, without notice, for any violation of these Terms.

    9. Governing Law

    • These Terms shall be governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts in Bhilwara, Rajasthan.
